Health Net to pay fines and penalties for unpaid chiropractic claims

Managed health-care company Health Net has agreed to pay $41 million in claims and fines for underpaying 88,000 New Jersey customers.

According to Banking and Insurance Commissioner Steven Goldman, Health Net had shortchanged customers on their out-of-network medical claims from 1996 to 2005, and on dental, mental health and chiropractic claims from 1999 to 2006.

The result of a state investigation, the $41 million total includes a $13 million fine, $14 million to the underpaid customers, $12 million in interest and $2 million in other fees. Reimbursements were mailed to current and former customers starting last month.

Health Net, once known as First Option Health Plan of New Jersey and Physicians Health Services of New Jersey, has 120,000 policyholders in New Jersey.

Protecting Chiropractic in Brazil

On June 26 the Federal Police in Brazil, acting on a complaint from physiotherapy leaders, detained visiting doctors of chiropractic and students from Palmer College’s Clinics Abroad program on the grounds that they were practicing physiotherapy without a license.

This was part of the PT profession’s aggressive campaign to have chiropractic declared a specialty of physiotherapy by law in Brazil.

This campaign is a response to draft chiropractic legislation promoted by the Brazilian Chiropractors’ Association (ABQ), representing Brazil’s duly qualified 360 DCs.

Currently there is no law regulating or recognizing the practice of chiropractic.

The ABQ, acting through lawyers, government authorities and legal processes in the capital Brazilia, has now been successful in getting an injunction against Physion and its ‘chiropractic’ teachers, on grounds of lack of qualifications and public safety.

On July 18 process servers armed with this injunction halted a Physion weekend course getting underway in the south of Brazil.

The national authority for PTs in Brazil, have challenged the injunction, but the judge denied this challenge on July 27. An appeal has been filed.

Physical Activity and Brain Function

Brisk walking could help mental function in older adults. An Australian study published in the Journal of the American Medical Association found slight improvements in cognitive function in older people who regularly engaged in brisk walking or other physical activity per week.

The study involved 85 people aged 50 and older who were experiencing memory problems. The participants were assigned to do at least 2 1/2 hours of physical activity per week, mainly brisk walking, for 6 months. They were compared with 85 people who were not asked to exercise. After 6 months, the people who exercised performed 1.3 points better on a 70-point scale of brain function than those who did not exercise.

The effects remained 18 months later, although the scores were lower. The results are as good as those seen with drugs prescribed to help Alzheimer's disease, according to the Associated Press.

The researchers could not say why exercise affects brain function. They also note that their results do not prove that exercise reduces the risk of dementia or Alzheimer's.

Running and Aging

Regular running slows the effects of aging, according to a new study from the Stanford University School of Medicine that has tracked 500 older runners for more than 20 years. Elderly runners have fewer disabilities, a longer span of active life and are half as likely as aging non-runners to die early deaths, the research found.

“The study has a very pro-exercise message,” said the study’s senior author. “If you had to pick one thing to make people healthier as they age, it would be aerobic exercise.” The new findings appear in the Aug. 11 issue of the Archives of Internal Medicine.

At the beginning of the study, the runners ran an average of about four hours a week. After 21 years, their running time declined to an average of 76 minutes per week, but they were still seeing health benefits from running.

On average both groups in the study became more disabled after 21 years of aging, but for runners the onset of disability started later.

“Runners’ initial disability was 16 years later than non-runners,’” “By and large, the runners have stayed healthy.”
